This website is operated by Home By Touch (“we,” “us,” “our”). We offer this site and all information, tools, and services (the “Service”) conditioned upon your acceptance of all terms, conditions, policies, and notices stated or referenced here.

By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), including additional terms and policies referenced or linked here (Privacy Policy, Return & Refund Policy, Shipping Policy, Purchase Options Cancellation Policy). These Terms apply to all users, including browsers, vendors, customers, merchants, and content contributors.

We may update these Terms at any time by posting a new date/version on this page. Your continued use of the site constitutes acceptance of changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell products and services to you.


1) ONLINE STORE TERMS

You represent that you are at least the age of majority in your state/province, or you are the age of majority and have consented to any minor dependents using this site. You may not use our products for illegal or unauthorized purposes or violate any laws. You must not transmit worms, viruses, or destructive code. Any breach may result in immediate termination of access.


2) GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. Content you submit (excluding payment card data) may be transferred unencrypted across networks and adapted to technical requirements; payment card data is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.


3) ACCURACY, COMPLETENESS & TIMELINESS

Material on this site is for general information. We do not guarantee it is accurate, complete, or current and it should not be the sole basis for decisions. Historical information may be provided for reference only. We may modify site contents at any time without obligation to update.


4) MODIFICATIONS TO SERVICE & PRICES

Product prices and availability may change without notice. We may modify or discontinue the Service (or any part/content) without notice. We are not liable for any modification, price change, suspension, or discontinuance.


5) PRODUCTS & SERVICES

Some products/services may be available exclusively online and may have limited quantities. Returns and exchanges are governed by our Return & Refund Policy. We attempt to display product colors/images accurately but cannot guarantee your monitor’s display. We may limit sales to any person, region, or jurisdiction and limit quantities per order. All descriptions and pricing may change at any time. We may discontinue any product at any time. We do not warrant that products/services or information will meet expectations or that errors will be corrected.

Product Standards & Origin

  • Our home-fragrance products are vegan and cruelty-free (no animal testing).

  • Many items are Miami-made in small batches and packaged locally.

  • Ingredient and safety information appears on product pages and/or labels. Contact info@homebytouch.shop with allergy questions before purchase.

Local Delivery & Pickup

  • Local delivery (Miami) may be available via Uber/Courier to eligible ZIP codes shown at checkout. A recipient must be available for handoff. When the courier marks “delivered,” risk of loss passes to the customer (see Shipping Policy).

  • Free local pickup is available at 14221 SW 120th St, Suite 106, Miami, FL 33186 during posted hours after you receive a “Ready for Pickup” notification. Bring your order number and ID.


6) ORDERS, BILLING & ACCOUNT INFORMATION

We may refuse any order and may limit or cancel quantities per person, household, or order (including orders using the same account, card, or shipping/billing address). If we change or cancel an order, we may try to notify you using the email/phone/address provided at purchase. We may limit/prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information and to promptly update details so we can complete transactions and contact you as needed. See our Return & Refund Policy and Purchase Options Cancellation Policy for more details.


7) OPTIONAL TOOLS & THIRD-PARTY APPS

We may provide access to third-party tools (e.g., subscriptions/purchase-options apps). Such tools are provided “as is/as available” without warranties; we have no liability arising from their use. Your use is at your own risk and subject to third-party terms.


8) THIRD-PARTY LINKS

Third-party links may direct you to websites we do not control. We are not responsible for examining or evaluating third-party content and assume no liability for materials, products, websites, or transactions. Review third-party policies carefully before transactions.


9) USER CONTENT: COMMENTS & SUBMISSIONS

If you send ideas, proposals, plans, or other materials (“comments”), you agree we may edit, copy, publish, distribute, translate, and otherwise use them in any medium without restriction and without obligation to compensate or respond. We may monitor, edit, or remove content we determine to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates intellectual property or these Terms. You are solely responsible for the accuracy and legality of your comments.


10) PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy (see the Privacy Policy page).


11) ERRORS, INACCURACIES & OMISSIONS

From time to time there may be information on the site or in the Service that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct errors or update information at any time without prior notice (including after you submit an order).


12) PROHIBITED USES

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for unlawful purposes; (b) to solicit unlawful acts; (c) to violate laws or regulations; (d) to infringe intellectual property; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false/misleading information; (g) to upload viruses or malicious code; (h) to collect or track others’ personal information; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for obscene or immoral purposes; or (k) to interfere with security features. We may terminate your use for violations.


13) CANCELLATIONS, RETURNS & RESTOCKING (Key Terms)

  • Order Cancellation Window: You may cancel within 12 hours of purchase or before a shipping label is created. For local delivery/pickup, you may cancel before we dispatch a courier or mark the order Ready for Pickup. Once shipped/dispatched/ready, follow the Return Policy.

  • Return Window: Eligible items may be returned within 14 days of delivery (or from courier handoff/pickup time), unused, in original packaging, with all inserts/gifts.

  • Restocking Fee: Eligible returns are subject to a 3% restocking fee, deducted from the refund. This fee is waived if the return is due to our error or a verified defect/damage on arrival.

  • Shipping Costs: We offer Forever Free Shipping on outbound orders where advertised. Customers are responsible for the cost of shipping returns back to us (use a trackable carrier). Original shipping costs are non-refundable.

  • Refused/Undeliverable Packages: If returned to us, we can reship (reship fee applies) or refund minus shipping and the 3% restocking fee.

  • Gift Cards: Final sale; expire 1 year from purchase, or any longer/no-expiration period required by law.

14) SUBSCRIPTIONS (Shopify Purchase Options / Appstle)

Manage subscriptions via the “Manage Subscription” link in your emails or by logging into your account. Changes made less than 24 hours before the next renewal may apply to the following cycle. Cancelling stops future renewals; any order already processed will ship as scheduled. If a discount required a minimum number of cycles and you cancel early, we may reverse the discount or convert it to store credit.


15) PRE-ORDERS

You may cancel a pre-order any time before we notify you the order is preparing to ship. If production has begun or a limited unit is allocated to you, refunds may be issued as store credit (as stated on the product page). If we miss the estimated ship window by more than 14 days, you may request a full refund.


16) SHIPPING

Processing times, carrier estimates, international duties/taxes, address issues, and lost/stolen package procedures are described in our Shipping Policy. Provide accurate addresses; once a label is created, we may be unable to change it.


17) INTELLECTUAL PROPERTY

All trademarks, service marks, logos, trade names, product names, images, text, graphics, videos, and other content are owned by Home By Touch or its licensors and may not be used without permission.


18) DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. The Service and all products delivered through the Service are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement, to the fullest extent permitted by law.

In no case shall Home By Touch, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, revenue, savings, data, replacement costs, or similar damages, whether in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any product, even if advised of the possibility. Some jurisdictions do not allow exclusion/limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.


19) INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Home By Touch and its parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms or violation of any law or third-party right.


20) SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.


21) TERMINATION

These Terms are effective unless terminated by you or us. You may terminate at any time by ceasing to use the site and notifying us. If we believe you have failed to comply with any provision, we may terminate this agreement without notice and you will remain liable for amounts due up to and including the termination date; we may also deny you access to the Service.


22) ENTIRE AGREEMENT

These Terms and any policies or operating rules posted on this site constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements, communications, and proposals (oral or written). Any ambiguities in interpretation shall not be construed against the drafting party.


23) GOVERNING LAW & VENUE

These Terms and any separate agreements whereby we provide you Services are governed by the laws of the State of Florida, USA, without regard to conflicts of law principles. Venue and jurisdiction lie exclusively in the state or federal courts located in Miami-Dade County, Florida.


24) CHANGES TO TERMS

You can review the most current version of the Terms at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates here. Your continued use of the site or Service following the posting of changes constitutes acceptance of those changes.
